General terms and conditions

Die Campingplatz Ostseequelle GmbH (nachfolgend „Campingplatz Ostseequelle“ genannt) vermietet an den Gast den vereinbarten Stellplatz (Zelt, Wohnmobil, Wohnwagen, Saisoncampingplatz) oder Mietunterkunft (Campingfass, Mietwohnwagen, Bungalow) (nachfolgend „Übernachtungsmöglichkeit“ genannt) mit der vereinbarten Ausstattung für die vereinbarte Aufenthaltsdauer. Diese Allgemeinen Geschäfts- und Buchungsbedingungen (nachfolgend „AGB“ genannt) gelten für Mietverträge zur Vermietung von Stellplätzen oder Mietunterkünften sowie alle in diesem Zusammenhang für den Gast (und seine Besucher siehe 9.) erbrachten weiteren Leistungen. Der Gast hat während seines Aufenthalts online verfügbar und im Büro ausliegende Platzordnung zu beachten.

• The prices are currently available on the internet pages of the Ostseequelle campsite and are linked to the booking programme (oqww.de). Other price lists are not valid and only provide indicative values (brochures and third-party internet portals).
  The agreed prices include the taxes and local charges applicable at the time of the conclusion of the contract. Not included are local taxes which are owed by the guest according to the respective local law, such as visitor’s tax.
  Price increases after conclusion of the contract may only be made if there are more than four months between the conclusion of the contract and the date of performance of the service. (cf. § 309 para. 1 no. 1 BGB). If the applicable VAT rate changes in the current calendar year, prices may be adjusted.
  With the booking, the guest offers Camping Ostseequelle the conclusion of a rental contract for the specified period and for the registered number of persons. In case of availability, the guest shall receive a booking confirmation from the Ostseequelle campsite either by e-mail or in person on site. The rental contract between the campsite Ostseequelle and the guest shall be concluded with the (down)payment of the invoice by the guest or with the receipt of the booking confirmation by the guest or with the entry to the campsite Ostseequelle (leaving the entrance area behind the barrier or over the bridge to block 2), whichever is earlier.

• The accommodation is rented as viewed. A change of pitch rental accommodation is only permitted after approval.
• You can make an extension yourself online (re-booking of the same accommodation option via interactive map). Please note the availability. We will be happy to advise you.
• Changes or rebookings, for example regarding the period, the number of persons or the accommodation option, are possible up to 31 days before arrival for a rebooking fee of 30,00 €. Bookings with a deposit paid can only be rebooked for the same calendar year. Changes made 30 days or more prior to arrival are considered cancellations (see below).
• A rebooking or cancellation of the reservation online is not yet possible. The guest must contact the Ostseequelle campsite directly in the event of a rebooking or cancellation request.
• The guest has no claim to the provision of a specific overnight accommodation. This also applies if this has been specially selected on the site plan or has been determined by the Ostseequelle campsite or to the fulfilment of special wishes that go beyond the provision of an overnight accommodation. He/she shall only be entitled to the provision of an overnight accommodation in the category booked by him/her.

• With the reservation, the stated deposit of 30% (including security deposit ) is due immediately (online payment). The payment options are clearly listed.
• The balance is generally due 30 days before the day of arrival. The guest will receive a link to the online final payment by e-mail. The balance can be paid at any time via the online view of his booking confirmation.
• If the deposit or the balance is not paid on time, the booking may become invalid immediately without the guest being reminded or informed again.
• If the arrival takes place in less than 30 days, the entire amount is due immediately.
• Non-assignable payments without a clear purpose (contract partner, reservation number, reservation date) or bundled payments for several bookings are not desired and will be returned and considered as not paid (see group travel).
• The prices for ancillary services (such as bicycle rental, rental pool, beach fees, fishing permits, visitors) and all other claims that are not expressly stated in the rental contract as part of the accommodation price) are usually due for payment immediately. In the event of late payment, the campsite is entitled to terminate the rental contract, whereupon the guest must vacate the room/pitch.
• The guest may only assert rights of set-off and retention if the underlying counterclaims are undisputed.

• Group travel (more information) with more than 2 persons of one generation without family connection or more than one accommodation option may not be booked online without permission, even in multiple transactions. Please use email correspondence for group requests.
• Group bookings without approval may be cancelled at any time without replacement.
• Each group must nominate a contact person/general manager before hand; note (e.g. joint and several debtor). This person has to submit a complete list of names with addresses and date of birth.
• The campsite Ostseequelle is entitled to withdraw from the contract at any time in case of false information regarding group travel. Please note that fees (and deposit) will be retained.
• Refunds for group bookings without authorisation may take up to 30 days.
• For persons between 14 and 29 years of age as well as for the setting up of pavilions (party tents), a separate deposit is due from the overall responsible person.

• A damage deposit is due for rental accommodation. After handing in the deposit slip, this will be transferred back to the balance payment account within 10 days, depending on the condition and meter reading of the electricity consumption. The amount of the deposit is shown during the booking process. Without deposit slip on request or at the end of the season October/November of a year.
• In special cases, Camping Ostseequelle may charge a further deposit (e.g. group trips).
• Camping Ostseequelle reserves the right to charge a deposit for other reasonable reasons.

The deposit or parts thereof may be retained in the following cases:

• • Late vacating of the rented accommodation by the guest.
  • Damage to or soiling of the rented accommodation which goes beyond normal signs of use.
  • Violations of the site rules, e.g. disturbance of the peace, which lead to complaints from other guests.

It is important that all guests treat the rental accommodation and the campsite with respect to ensure that the full deposit is returned.

• You can find our current opening hours at the office (blue house opposite the barrier) and on our website (contact).
  If we are not available, you can reach us by phone.
• To shorten waiting times, please book in advance.
• Arrival and departure dates stated in the booking confirmation are binding.
• Arrival is possible from 16:00 hrs for rental accommodation and from 13:00 hrs for a pitch. Earlier arrival is only possible if there is availability, up to the day before and for an additional night’s accommodation.
• The rental accommodation will be kept free for you until 15 minutes before the office closes on the day of arrival, the parking space until 11 the following day. The guest is obliged to inform us immediately of a different or later arrival.
• To fulfil the registration formalities, each guest books online, visitors register at the information office with a valid identity card before entering the campsite. Upon request, this data will be passed on to authorities or municipal offices. The registration data will not be passed on for commercial purposes.
• The registration number is required for access to the Ostseequelle campsite (exception: bungalows) with a vehicle. Register the correct number plate. The barrier system grants access and egress during opening hours between 7:00 and 22:00 hrs if access is valid via visual number plate recognition. Emergency services have 24-hour access. The number plate recognition works 99% of the time.
• Keep your number plate clean and level. If you have any problems, please contact the office.
• Valid access requires full payment for the period of arrival and departure.
• Departure must take place during office opening hours by 11:00 a.m. in the case of a pitch or by 10:00 a.m. in the case of rental accommodation. A late departure is only possible after consultation, availability and against surcharge of a further overnight stay.
• At the end of the rental period, the guest must return the accommodation facility vacated and in a clean condition. The condition that existed at the time of handover of the rented property must be restored, whereby deterioration due to contractual use is irrelevant. If the guest does not comply with this obligation, the Ostseequelle campsite shall be entitled to restore the condition at the guest’s expense.

• In the low season, depending on the weather, not all site areas or areas will be open.
• In the low season we reserve the right to change the opening hours of the reception.
• In the high season a staff member is personally available 24h on the site. In the low season we are only reachable by phone outside the opening hours of the reception.
• In the high season we allow only max. 1 dog per pitch for the welfare of guests and dogs.
• The minimum stay is regulated according to the main season, low season and type of accommodation. Furthermore, specific arrival and departure days are set for the main season:
  • Bungalow type 1: arrival-departure day: Friday; minimum stay high season 7 nights; low season 3 nights.
  • Bungalow type 2 :Arrival- Departure day: Thursday; Minimum stay high season 7 nights; Low season 3 nights
  • Bungalow type 3 :arrival-departure day: Sunday; minimum stay high season 7 nights; low season 3 nights
  • Bungalow type 4 :arrival-departure day: Saturday; minimum stay high season 7 nights; low season 3 nights
    Camping pod: arrival-departure day: minimum stay high season 2 nights; low season one night
    Camper home: minimum stay high season 7 nights; low season 3 nights

• The campsite Ostseequelle may be entered only by the registered persons.
• Registered are the persons named in the contract. Other visitors are subject to visitor fees.
• Visitors without access permission by the staff pay an increased fee of 60 Euros (€) per day per person.
  The visiting guest/permanent camper shall register his/her visitors at least one day prior to arrival and shall be liable for payment of visitor fees as well as for compliance with the general terms and conditions and site regulations.
• Visitors’ cars shall be parked outside the Ostseequelle campsite. The campsite Ostseequelle can grant exceptions with costs.

• The bringing of dogs and cats (hereinafter referred to as “pets”) requires prior notification by the guest; for other animals, the exact species designation must be requested from Campingplatz Ostseequelle, whereby the campsite may refuse consent in all cases at any time and without giving reasons.
• A maximum of one pet per pitch and accommodation is allowed, no cat in a camping barrel or bungalow type 3. An additional fee must be paid for each pet brought along, the amount of which will be communicated by the campsite to the guest at the time of notification.
• Pets are not allowed in the sanitary buildings and in bungalows type 1, 2 and 4, which are also rented to people with allergies. Dogs are also not allowed on the terraces of bungalows type 1, 2 and 4!
  If it is discovered by the end of the rental period that this has not been complied with, we will charge a flat fee of min. 200,- € for ventilation, cleaning and loss of rent, replacement hotel, compensation, as allergy sufferers will not be able to book these for a longer period of time. If necessary, we will give the order to an external company (min. 500,- €). In the case of a lump sum, the guest is free to prove that the actual costs incurred are lower.
• Dogs are not allowed to stay in beds or on upholstered furniture in our rental accommodation. If hair is detected, a special cleaning service will be commissioned for a fee.
• Damage or dirt caused by pets must be removed immediately by the pet owner. The guest must ensure that the dog remains on its own pitch.
• There is a general leash obligation on the entire site (no cross-country leash).
• Dangerous dogs according to §2 HundehVO M-V (04.07.2000) are prohibited for the protection of fellow human beings.
  Express reference is made to the validity of the Dog Owners’ Ordinance – HundehVO M-V (04.07.2000) in its currently valid version. In the event of violations of §9 of the Dog Owners’ Ordinance (administrative offences) and/or not only insignificant disturbance of other guests by dogs brought along, we reserve the right to terminate the contract without notice for good cause and to issue and enforce a house ban.

• The rental accommodation is equipped as described on the website of Camping Ostseequelle. In addition to the rental fee, the guest also pays for the eco-electricity consumption according to the price list.
• The keys are handed over at the reception (house number 21). Required information will be given to the guest in time before arrival.
• Upon handover, the equipment list and the defect-free condition of the rental accommodation are checked by the guest. The handover document is to be signed by both parties on the day of arrival and bindingly reflects the condition of the rental accommodation on the day of arrival.
• The guest can rent bed linen and towels separately. If available, children’s travel cots and high chairs can also be rented.
• Bedding (rental units): In any case, the beds must be made before use. Either with bed linen brought by you or booked on site.
• It is not allowed to set up tents or caravans on the area where the rental accommodation is located. The car is to be parked on the assigned parking area and is not allowed to drive on the lawns even for loading and unloading.
• The final cleaning of the rental accommodation will be done by the campsite Ostseequelle. The final cleaning does not include the cleaning of dishes, the cleaning of coarse soiling of the oven, the kitchen stove or the fireplace stove as well as the emptying of garbage; if necessary, the guest has to carry out this cleaning work. If he fails to do so, these cleaning works will be charged to the guest according to the price list.
• Upon return of the rented accommodation, the condition of the same and its equipment shall be checked by the guest on the basis of a handover protocol. The handover protocol is to be signed by both parties on the day of departure and is binding for both parties to reflect the condition of the rental accommodation at the end of the rental period. Keys are to be handed over to the campsite Ostseequelle. Losses and damages resulting from the handover protocol will be charged to the guest by Camping Ostseequelle.
• Bringing pets requires the prior consent of the campsite Ostseequelle.

• The responsible party for the processing of personal data (“data processing”) is Campingplatz Ostseequelle GmbH. The guest can find further information on the website and in the context of the booking process retrievable data protection notices. Contact details of the data protection officer: The guest can contact our data protection officer by e-mail, telephone or via our postal address.
• The customer agrees that his personal data and data relevant to payment processing collected by us in the course of customer service will be stored and automatically processed. Both parties to the contract will comply with the relevant provisions of the EU General Data Protection Regulation (“DSGVO”), the Federal Data Protection Act (“BDSG”) and all other relevant laws, both during the duration of the contractual relationship and after its termination.
• If the campsite Ostseequelle has received the e-mail address of the guest in the course of the contract, it will use it to occasionally send information about its offers, if the tenant has not objected to this. An objection is possible at any time by e-mail to info@ostsee-campingplatz.de or also by post. Data will only be passed on to third parties within the framework of legal requirements. We only pass this on if this is necessary for contractual purposes according to Art. 6 Para. 1 lit. b) DSGVO, we are obliged to do so due to legal requirements (Art. 6 Para. 1 lit. c) DSGVO or we have a legitimate interest according to Art. 6 Para. 1 lit. f.) DSGVO in the economic and effective operation of our business. This includes service providers who are commissioned in the context of data protection order processing pursuant to Art. 28 DSGVO for, among other things, the technical operation of the booking systems or with the implementation of the rental agreement at the campsite. We have taken appropriate legal precautions and corresponding technical and organizational measures to ensure the protection of personal data in accordance with the relevant legal provisions. The data processing is carried out in the European Union. The campsite does not transfer data to a third country (i.e. a country outside the European Union (EU) or the European Economic Area (EEA)).
• The campsite is monitored with video cameras in critical sub-areas. This is done for the safety of campers (detection and prevention of safety hazards), protection of property and possessions, control of access authorizations and exercise of domiciliary rights. The recordings will only be evaluated in case of need and only the required data will be stored until clarification. Data is only passed on to third parties within the framework of legal requirements. The video recordings are regularly deleted automatically in accordance with § 6b Abs BDSG. In addition, the recording device is protected from access by unauthorized third parties by suitable measures in accordance with § 9 BDSG.
• At regular intervals, we carry out image and sound recordings on our vacation resort for marketing purposes. If you do not want this, we ask you to inform the photographer or camera team immediately. If persons are not only to be recognized as so-called “accessory”, no publication will take place without consent of the persons concerned.
• If Campingplatz Ostseequelle processes personal data of a guest, the guest is a data subject in the sense of the GDPR and has the following rights: right to information (Art. 15 GDPR), right to rectification (Art. 16 GDPR), right to erasure (Art. 17 GDPR), right to restriction of processing (Art. 18 GDPR), right to data portability (Art. 20 GDPR) and right to object to processing (Art. 21 GDPR). Furthermore, the guest has the right to complain to a data protection supervisory authority pursuant to Art. 77 DSGVO in conjunction with. §19 BDSG to complain. In the case of a request for information that is not made in writing, Camping Ostseequelle may demand proof from the guest that the guest is the person the guest claims to be.
• The data stored at Campingplatz Ostseequelle will be deleted as soon as they are no longer necessary for their intended purpose and the deletion does not conflict with any legal obligations to retain data. Storage obligations arise in particular for reasons of commercial and tax law. According to legal requirements, data is stored for 6 years in accordance with § 257 para. 1 HGB (commercial letters, accounting records.) and for 10 years in accordance with § 147 para. 1 AO (accounting records, commercial and business letters, taxation-relevant documents and registration certificates of tourism).

• The guest has the right to withdraw from the booking. In your own interest and to avoid misunderstandings, the withdrawal must be declared in writing (by e-mail, not by cell phone / messenger) in advance. Decisive for the time of withdrawal is the receipt of the declaration of withdrawal by us. If you withdraw from the contract, we may charge a reasonable cancellation fee according to the following schedule:
  • up to 30 days before arrival 30% of the total amount.
  • In case of a later cancellation or if you do not start your trip without informing us, or if you cancel your booking only on the day of arrival, or if you do not make use of all or part of the services, we retain our full claim to the rental price.
• The cancellation fee is at least 25€ for pitches and 50€ for rental accommodation.
  • In case of chargebacks by the customer (e.g. of direct debits, “chargebacks”) without prior written confirmation, the customer will be charged processing and bank fees of at least 90€.If the booked arrival date is postponed without your notice or an earlier departure takes place, your overnight accommodation can be allocated elsewhere on the next day. The occupancy of unoccupied overnight accommodation by the campsite Ostseequelle does not mean the provision of a substitute tenant, as long as this guest could have been accommodated in another overnight accommodation of the same type.
  • If the guest cancels the use before the end of the agreed rental period, the proportional rent will not be refunded. However, the campsite Ostseequelle must take into account the value of the saved expenses such as pro rata electricity costs per day as well as those benefits that it gains from an alternative use of the use (§ 537 paragraph 1 sentence 2 BGB), unless the guest is responsible for the termination of use.
  • In case of late arrival or early departure, there is no refund of a proportional amount of the deposit paid, unless intentional or grossly negligent action of the campsite Ostseequelle has caused the early departure mandatory.
    There is no legal claim to the supply of electricity. Electricity can only be provided if a connection possibility exists.

The cover provided by our travel cancellation protection comes into effect if one of the persons listed in the booking is unable to travel or has to leave early for unexpectedly serious reasons of illness (submission of medical certificate) or death of a first-degree relative (proof required). Cancellation must be made immediately, proof can be submitted later. Our travel cancellation cover can only be taken out at the time of booking and not retrospectively. Costs are calculated on a percentage basis and displayed in the booking process.

• The Ostseequelle campsite is entitled to withdraw from the contract extraordinarily for factually justified reasons, for example if – force majeure or other circumstances beyond the control of the Ostseequelle campsite make it impossible to fulfill the contract. Furthermore, if overnight accommodations have been culpably booked with misleading or false information about facts essential to the contract, e.g. personal information of the guests, group travel, size information for vehicles/trailers, weight information for mobile homes; if fictitious reservations have already been made in the past or if the Ostseequelle campsite has justified reason to believe that the use of the service may jeopardize the smooth operation, safety or public image of the Ostseequelle campsite, without this being within the control or organization of the Ostseequelle campsite. The guest is not allowed to use the services of the campsite Ostseequelle if the guest is not a member of an extremist organization.
• In exercise of the domiciliary rights, the staff of the campsite may refuse to admit persons, expel them from the site or issue and enforce a permanent house ban, if this appears necessary to maintain safety, site regulations and GTC. If the causer cannot be identified, the entire group/family of the accommodation option(s) is affected.
• The campsite Ostseequelle is entitled to terminate the contract for cause without notice (§569 BGB) to enforce the site rules and GTC. In particular if the guest during his stay insults or endangers other guests or the staff, disturbs the peace and order sustainably, expresses or behaves in a hostile or otherwise discriminatory manner, wantonly destroys, damages or removes the inventory of the site or the equipment (theft), in case of misuse of electricity, fresh water or sewage infrastructure, is under illegal drug consumption, is intoxicated, uses for the exercise of a commercial activity and / or if he behaves in any other way contrary to the contract. This applies in particular to violations of ordinances of the Infection Protection Act due to, for example, the current corona pandemic.
• A claim for refund of the paid (pro rata) fee and/or the deposit does not exist in these cases (see c. ). Unless the guest proves that the campsite has less damage than the payment made.

In the event of chargebacks by the customer (e.g. return debits, “chargebacks”, buyer protection negotiations via Paypal) without prior written confirmation, the customer will be charged processing and bank fees of at least 90 euros.

• The guest assumes liability, especially towards third parties
  • In case of improper electricity connections
  • In case of damages caused by the gas installations belonging to him
  • In case of damage to objects, facilities, nature and environment of the campsite.
  • In case of blockage due to waste disposal in toilets.
• The use of the campsite and its facilities is at your own risk.
• The strict liability of the campsite Ostseequelle and/or its employees (hereinafter Campsite) for initial material defects of the rented property is excluded. Apart from that, the guest (his relatives and visitors) can only claim damages from the campsite if the campsite is guilty of intent or gross negligence or if the campsite has culpably violated essential contractual obligations; in the latter case, however, the campsite’s liability for damages shall be limited to the foreseeable, typically occurring damage. Examples for which no liability is assumed:
  • In case of power outages, storm and weather damage, flood and lightning or hail damage.
  • In case of burglary or theft
  • When moving caravans to prevent a hazard
• Any complaints regarding the pitch or rented accommodation must be reported immediately to the campsite by the guest. The assertion of defects is excluded, if they have not been reported directly to the campsite during the guest’s stay. The campsite shall be given a reasonable period of time to remedy the defect (rectification).

• With appear all previous GTC lose their validity.
• Any invalidity of one or more of the above provisions shall not affect the validity of the remaining provisions.
• We reserve the right to correct errors, misprints and miscalculations.
• Deviating and / or supplementary agreements require the express written (e-mail) confirmation of the campsite Ostseequelle.
• Alternative Dispute Resolution pursuant to Art. 14 (1) ODR Regulation and Section 36 VSBG
  The European Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/consumers/odr/. The Lessor is not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
• Reservation of errors: The lessor reserves the right to correct errors such as printing and calculation errors.
• The masculine form chosen in the General Terms and Conditions (GTC) always refers to female, male and various persons at the same time. Multiple designations are generally dispensed with in favour of better readability.
